1. Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you," "User") and GoGetit Technologies - FZCO ("GoGetit," "we," "us"). By accessing or using our website, mobile applications, or any related services (collectively, the "Platform"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Platform.
2. The GoGetit Platform
GoGetit provides a technology platform that connects users seeking to send items ("Customers") with independent third-party delivery providers ("Delivery Heroes"). YOU ACKNOWLEDGE THAT GOGETIT DOES NOT PROVIDE DELIVERY OR LOGISTICS SERVICES OR FUNCTION AS A TRANSPORTATION CARRIER. ALL SUCH DELIVERY SERVICES ARE PROVIDED BY INDEPENDENT THIRD-PARTY CONTRACTORS WHO ARE NOT EMPLOYED BY GOGETIT.
3. User Accounts
To use the Platform, you must register for an account. You must be at least 18 years old and provide accurate, current, and complete information. You are responsible for all activity that occurs under your account and agree to maintain the security and secrecy of your account username and password at all times.
4. User Obligations and Conduct
You agree to use the Platform for lawful purposes only. You will not use the Services to send any prohibited items, including but not limited to illegal substances, hazardous materials, stolen goods, weapons, or any item you do not have the right to send. For a comprehensive list, please review our Prohibited Items. GoGetit reserves the right to refuse, cancel, or inspect any package at its discretion.
5. Terms for Customers
As a Customer, you agree that payment for all delivery services is due immediately upon booking. GoGetit facilitates this payment on behalf of the Delivery Hero. All charges are non-refundable once a delivery service has commenced, except as determined by GoGetit. You are responsible for ensuring that your items are properly packaged for transport.
6. Terms for Delivery Heroes
As a Delivery Hero, you acknowledge you are an independent contractor, not an employee of GoGetit. You are responsible for providing your own equipment (vehicle, smartphone) and covering all associated costs (fuel, maintenance, data). You represent and warrant that you hold a valid driver's license, all necessary vehicle registrations and insurance, and will comply with all applicable laws.
7. Intellectual Property
The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by GoGetit, its licensors, or other providers of such material and are protected by international copyright, trademark, and other intellectual property laws.
8. Disclaimers and Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." GOGETIT DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, NOT EXPRESSLY SET OUT IN THESE TERMS, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
GOGETIT SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE PLATFORM. GOGETIT SHALL NOT BE LIABLE FOR ANY DAMAGES, LIABILITY, OR LOSSES ARISING OUT OF YOUR USE OF OR RELIANCE ON THE PLATFORM OR YOUR INABILITY TO ACCESS OR USE THE PLATFORM.
IN NO EVENT SHALL GOGETIT'S TOTAL LIABILITY TO YOU IN CONNECTION WITH THE SERVICES FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE EQUIVALENT OF ONE HUNDRED U.S. DOLLARS (US$100).
9. Indemnification
You agree to indemnify and hold GoGetit and its affiliates, officers, directors, employees, and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys' fees) arising out of or in connection with: (i) your use of the Platform; (ii) your breach or violation of any of these Terms; or (iii) your violation of the rights of any third party, including Delivery Heroes.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Dubai International Financial Centre (DIFC), Dubai, United Arab Emirates. Any dispute arising out of or in connection with these Terms shall be resolved through binding arbitration in Dubai, UAE, under the rules of the DIFC-LCIA Arbitration Centre.
11. Termination
GoGetit may, in its sole discretion, suspend or terminate your account and access to the Platform at any time and for any reason, including for a breach of these Terms, without prior notice.
